Irvine Public Schools Foundation – Instrument Rental Program Terms & Conditions 

Effective Date: July 22, 2025 

 

Payment Authorization 

By signing the rental agreement, I authorize the Irvine Public Schools Foundation (IPSF) to charge the rental fee listed in the agreement. Charges will begin the month after the initial rental period and continue until the instrument is returned, or when this authorization is terminated in writing. I understand that: 

  • I will be charged a full month’s rent for every month, or any portion of the month, that I retain the rented instrument after the initial rental period. 

  • If the credit card charge does not process, and I do not submit alternative payment, I may be subject to late fees if I do not provide alternative payment information within 10 business days of notification by IPSF.  

  • I further represent and affirm that, by signing the agreement, I am the authorized user of the credit card identified above.  

Rental Periods and Payment 

If I choose the 3-month rental option, the initial rental period will be for a minimum of 3 months and is nonrefundable, continuing thereafter with monthly installments in the rental amount for this instrument. I agree that the subsequent monthly rental payments in the rental amount for this instrument will begin 3 months from the date of the instrument rental. 

If I choose the full school year rental option, I agree that, at the conclusion of the full school year, subsequent rental payments will be monthly, in the monthly amount for this instrument and will begin in July 2026. 

I give IPSF the authority to charge my credit card for any rental payments and late charges that are thirty (30) days or more past due. Unless I am enrolled in the Optional Customer Assurance Program, I give IPSF the authority to charge my credit card the full replacement value of the instrument (as noted below) if it is not returned or destroyed or damaged beyond repair or use.

I understand that IPSF shall at all times maintain title to the instrument and reserves the right to request the return of the instrument at any time and for any reason. In the event that I fail to return the instrument when requested or required to do so, I agree to pay associated costs (such as reasonable attorneys' fees and actual court costs) incurred by IPSF in its attempt to secure the return of the instruments or any payments thereon. 


Optional Customer Assurance Program 

If enrolled in the Optional Customer Assurance Program, IPSF will repair damaged instruments or replace lost or stolen instruments, in exchange for a $5.00 monthly fee. This coverage is contingent upon timely and full payment of monthly instrument rental fees.  

  • This program does not include intentional or reckless damage to the instrument, for which I remain responsible.  

  • I understand that my instrument will be subject to inspection by IPSF staff if I choose to enroll at a later date. 


Instrument Repairs 

All repairs to instruments and string replacements must be performed by IPSF or its designated agents. Unless I am enrolled in the Optional Customer Assurance Program, I understand that I am responsible for any and all repair costs for the instrument.  

 

Instrument Purchase Option 

Rental payments made over the course of six (6) consecutive months may be applied towards the purchase of the rented instrument or any other instrument of equal or greater value offered by IPSF. In the event of an instrument purchase, the instrument will be sold “as is”. No warranties shall apply, and no returns will be accepted. 

Terminating Agreement 

At any time prior to the end of a monthly rental period, I may terminate this agreement by returning the instrument in good condition to the IPSF Instrument Rental Office, in full satisfaction of any future obligations under this Agreement except as to current and past-due payments. I understand: 

  •  Rental periods may not coincide with the end date of my child’s band or orchestra program.  

  • Any payment received more than (10) days late will be subject to a $5.00 late charge.  

  • Rental charges will continue until the instrument is returned to the IPSF Instrument Rental Office.  

  • No refunds will be issued for early returns or partial months.  


Release from Liability 

I agree to indemnify and hold harmless IPSF and its directors, trustees, officers, agents, contractors, and employees from any liability, claims, or actions, including costs and expenses relating thereto, resulting from or arising out of the use of instruments rented under the IPSF Instrument Rental Program. Any delay or failure by IPSF in the enforcing strict performance of this Agreement (such as accepting late or partial payments) shall not be considered as a waiver of any of the terms of this agreement or any of IPSF’s legal rights arising under this agreement.  

By entering into a rental agreement with Irvine Public Schools Foundation, I agree to abide by IPSF’s Terms and Conditions and Privacy Policy
